What is Florida’s Super Speeder Law?
Under Florida’s House Bill 351, effective July 1, 2025, the state has created a new criminal offense called “dangerous excessive speeding”. This applies to drivers who exceed the posted speed limit by 50 mph or more, or who operate a vehicle at 100 mph or more in a manner that endangers others or interferes with vehicle operation. Unlike standard traffic infractions, individuals cited under this law must appear in court, as there is no option to resolve the violation by mail. Law enforcement now has the authority to arrest drivers on the spot for this offense, replacing the traditional civil citation process.
Penalties Under the Law
- First Offense: Up to 30 days in jail, a fine of up to $500, or both.
- Second or Subsequent Offense (within five years): Up to 90 days in jail, a fine of up to $1,000, or both, and mandatory driver’s license revocation of 180 days to one year.
- Mandatory Court Appearance: Every individual charged must attend a scheduled hearing before a designated official.
How Does Florida Compare to Georgia?
Florida’s law differs from Georgia’s Super Speeder program in key respects. In Georgia, drivers convicted of traveling 75 mph or more on a two‑lane road or 85 mph or more on any highway receive an extra $200 state fee on top of local fines, and failure to pay within 120 days results in license suspension. Georgia’s program does not criminalize the offense nor impose jail time solely for speed. By contrast, Florida’s law criminalizes extreme speeding statewide and introduces potential jail sentences and higher fines as primary penalties.
Other State Approaches
In Virginia, drivers who exceed the speed limit by 20 mph or more, or who drive 85 mph or more regardless of the posted limit, can be charged with reckless driving – a class 1 misdemeanor punishable by up to one year in jail and fines up to $2,500. These offenses also carry driver’s license suspension and points.
