DUI Punishments in Florida

Each state maintains their own laws regarding DUI and subsequently their own punishments. Essentially, if you violate DUI laws you are guilty of:

  • Driving a vehicle, be it a car, truck, motorcycle or a vehicle used for commercial purposes, while you are impaired from the use of alcohol, drugs, prescription medication or medications purchased over the counter.
  • Driving with blood-alcohol concentration levels exceeding the allowable limit which is .08.

The punishments for DUI in Florida are as follows:

  • First offense – maximum jail sentence of six months, driver’s license suspended or revoked for six months, participate in a required alcohol education class, attend mandatory alcohol treatment and assessment, chance of car being confiscated and the possibility of implementation of an ignition interlock device.
  • Second offense within five years – mandatory jail sentence of ten days (maximum of nine months), driver’s license suspended or revoked for one year, participate in a required alcohol education class, attend mandatory alcohol treatment and assessment, chance of car being confiscated and implementation of an ignition interlock device.
  • Third offense within ten years – mandatory jail sentence of thirty days (maximum one year) driver’s license suspended or revoked for two years, participate in a required alcohol education class, attend mandatory alcohol treatment and assessment, chance of car being confiscated and implementation of an ignition interlock device.
