APPEALS & POST-CONVICTION RELIEF

Anywhere in the State of Florida

Appeals - A trial or guilty plea is not necessarily the end of a case. There may still be hope to challenge your conviction and sentence.

The appellate attorneys at Robert Shafer & Associates have successfully litigated numerous appeals. When a defendant files an appeal, it means that they are requesting that a higher court review the decisions of the court that handled (or is handling) their case. You may need an appellate attorney if you:

  • lost at trial
  • filed a motion to suppress and it was denied
  • filed a motion to dismiss and it was denied
  • were given an illegal sentence
  • were not told that you had the right to an attorney before entering a plea
  • were not aware of the nature & consequences of the charges you pled to

The appellate process has many steps. It requires the person requesting an appeal to gather a record of the lower court’s proceedings and file a written argument explaining why the lower court erred. Our attorneys have extensive appellate experience and can advise you as to whether or not there is any merit to an appeal.

There are very strict time limits in the appellate process, and once time expires, you may never be able to file an appeal again! If you have questions regarding any appellate issue please do not hesitate to contact us at 1-866-681-9544.
